Dear Port Users,
The Independent Consumer and Competition Commission (“ICCC”) conducted a Stevedoring and Handling Services Pricing Review (“Review”) during the year resulting in a Final Report issued on 8 December 2023.
ICTSI South Pacific Limited’s (“ISPL”) position is that the Review does not enable the ICCC to make Prices Orders on SPICT and MIT, and furthermore, ISPL contests most of the financial calculations, assumptions, assertions, and claims contained in the Final Report.
Therefore, ISPL had no choice but to commence legal proceedings against the ICCC.
In those proceedings, the National Court granted ISPL a Stay of the Price Orders the ICCC had made on 5 December as a result of the Review.
A final hearing of the proceedings will be held in the National Court in 2024.
While legal proceedings are ongoing, SPICT and MIT will continue to operate as usual.
Accordingly, the 2023 Public Tariff (Regulated and Unregulated) will be extended unchanged into 2024.
